Who’s Responsible If a Fire Door Fails?

When a fire door fails during a fire, responsibility and repercussions depend on who had the legal duty to ensure the door was compliant and why it failed. Here’s a breakdown: 

Who is responsible?

The Responsible Person (RP) under the Regulatory Reform (Fire Safety) Order 2005 (RRO) is accountable. This is typically:

The employer (if the premises are a workplace),

The building owner or landlord,

Or a person in control of the premises (e.g., facilities manager, managing agent).

They must ensure all fire safety equipment — including fire doors — is properly installed, maintained, and inspected.

A person or organisation may be liable if:

The fire door was non-compliant with regulations (e.g. wrong materials, gaps, intumescent seals missing).

There was no inspection/maintenance regime.

Known defects were ignored.

Work (installation or repairs) was done improperly or by unqualified contractors.

If a fire door failure leads to injury, death, or significant damage:

The Responsible Person may face:

Prosecution under the RRO.

Fines or imprisonment (unlimited fines and up to 2 years in prison for serious breaches).

Civil liability — claims for damages from affected parties.

Inquest findings and reputational damage.

Contractors (installers/inspectors) may be liable if:

They provided negligent work or false certification.

Example:
